Abstract: Der Autor war Präsident des Bundesverwaltungsgerichts, also Jurist. - Fertige und rundherum befriedigende Aussagen zu Kohlhaas sind schwierig. Das liegt auch daran, daß man es als Gretchenfrage an den Juristen bezeichnen kann, wie er es mit Michael Kohlhaas hält. Denn diese Frage will letztlich eine Antwort darauf haben, wie er zum Recht und zur Gerechtigkeit steht. Gretchenfragen aber haben es so an sich, daß sie den Befragten noch selten zu einer präzisen Antwort veranlaßt haben, sondern eher ein Ausweichen oder ein Drumherumreden bewirken: das ist Gretchen mit ihrem Faust bekanntlich auch nicht anders ergangen. Gretchenfragen führen eben in der Regel zu zentralen Problemen, für die keine Wissenschaft einfache Antworten bereithält. Auch Juristen wissen über den Zentralbegriff ihrer Wissenschaft relativ wenig; trotz der unzähligen Bücher, die klären wollen, was Recht und Gerechtigkeit sei, fehlt uns noch immer eine wirklich schlüssige, vor allem eine konkrete Antwort mit präziser praktischer, sozusagen vollzugsfähiger Nutzanwendung. Ich weiß nicht, ob es für uns Juristen ein Trost sein kann, daß es den andern drei klassischen Wissenschaften mit ihren Zentralbegriffen nicht viel besser geht: Die Theologen wissen auch nicht so recht, was sie unter Gott zu verstehen haben, die Mediziner kaum, was Gesundheit und Krankheit wirklich ist, und die Philosophen haben noch immer ihre Schwierigkeit, ihre alte Gretchenfrage - Verzeihung: dort heißt es Pilatusfrage - nach der Wahrheit zu beantworten. Sprache.
